EL CONSEJO DE LAS COMUNIDADES EUROPEAS,
Visto el Tratado constitutivo de la Comunidad Económica Europea y, en particular, su artículo 113,
Vista la Decisión 69/494/CEE del Consejo, de 16 de diciembre de 1969, referente a la progresiva uniformidad de los acuerdos relativos a las relaciones comerciales de los Estados miembros con terceros países y la negociación de acuerdos comunitarios (1), y, en particular, su artículo 3,
Vista la propuesta de la Comisión,
Considerando que, para los tratados de amistad, de comercio y de navegación y acuerdos similares celebrados por los Estados miembros, la tácita reconducción o el mantenimiento en vigor más allá del período de transición fue autorizado en último lugar por la Decisión 86/19/CEE (2);
Considerando que los Estados miembros interesados han solicitado la autorización para reconducir tácitamente o mantener en vigor las disposiciones cuyas materias estén sujetas a la política comercial común, en el sentido del artículo 113 del Tratado, y que están contenidas en los tratados de amistad, comercio y navegación y acuerdos similares enumerados en el Anexo, para evitar una discontinuidad en sus relaciones comerciales convencionales con los terceros países afectados;
Considerando, no obstante, que la mayoría de los ámbitos cubiertos por dichas disposiciones de los tratados y de los acuerdos nacionales son en adelante objeto de acuerdos comunitarios; que, en esas condiciones, se trata de autorizar el mantenimiento de dichas disposiciones solamente para los ámbitos no cubiertos por acuerdos comunitarios; que, en consecuencia, esta autorización no debe contravenir la obligación de los Estados miembros de evitar y, en su caso, eliminar toda incompatibilidad entre dichos tratados y acuerdos y las disposiciones del Derecho comunitario;
Considerando que, además, las disposiciones de los tratados y de los acuerdos que se deban reconducir tácitamente o mantener en vigor no deben constituir, durante el período considerado, un obstáculo a la ejecución de la política comercial común;
Considerando que los Estados miembros interesados han declarado que la tácita reconducción o el mantenimiento en vigor de dichos tratados y acuerdos no constituye un impedimento a la apertura de negociaciones comerciales comunitarias con los terceros países afectados ni a la transferencia de las materias comerciales de los acuerdos bilaterales existentes a acuerdos comunitarios;
Considerando que, durante la consulta prevista en el artículo 2 de la Decisión 69/494/CEE, se ha comprobado, como lo confirman las declaraciones antes citadas de los Estados miembros interesados, que las disposiciones de dichos tratados y acuerdos bilaterales no constituyen, durante el período considerado, un obstáculo para la ejecución de la política comercial común;
Considerando, no obstante, que los Estados miembros interesados han declarado estar dispuestos a proceder a la adaptación o, en su caso, a la denuncia de dichos tratados y acuerdos, en la medida en que la reconducción tácita o el mantenimiento en vigor de las disposiciones relacionadas con las materias a que se refiere el artículo 113 del Tratado demostrase, durante el período considerado, ser un obstáculo para la ejecución política comercial común;
Considerando que los tratados y acuerdos de que se trata contienen cláusulas de denuncia con un plazo previsto entre tres y doce meses;
Considerando que, en estas condiciones, nada se opone a la tácita reconducción o al mantenimiento en vigor de dichas disposiciones hasta el 31 de diciembre de 1988,
HA ADOPTADO LA PRESENTE DECISION:
Artículo 1
Las disposiciones cuyas materias estén sujetas a la política comercial común en el sentido del artículo 113 del Tratado y que estén contenidas en los tratados de amistad, comercio y navegación y acuerdos similares enumerados en el Anexo, en los ámbitos no cubiertos por los acuerdos entre la Comunidad y los terceros países de que se trate, y siempre que no estén en contradicción con las políticas comunes existentes, podrán ser reconducidas tácitamente o mantenidas en vigor, hasta el 31 de diciembre de 1988.
Artículo 2
Los destinatarios de la presente Decisión son los Estados miembros.
