EL CONSEJO DE LA UNION EUROPEA,
Visto el Tratado constitutivo de la Comunidad Europea y, en particular, su artículo 113, en relación con la primera frase del apartado 2 de su artículo 228,
Vista la propuesta de la Comisión,
Considerando que la eliminación de aranceles por Estados Unidos y la Comunidad Europea se considera globalmente beneficiosa;
Considerando que Estados Unidos y la Comunidad Europea han preparado un Acuerdo en forma de memorándum de acuerdo sobre las bebidas espirituosas; que el Acuerdo incluye modificaciones de un Programa Comunidad Europea-Bebidas espirituosas CXL que debería ser sometido a la Organización Mundial del Comercio;
Considerando que el Acuerdo en forma de memorándum de acuerdo entre la Comunidad Europea y Estados Unidos de América sobre las bebidas espirituosas
debería ser aprobado en nombre de la Comunidad,
DECIDE:
Artículo 1
Queda aprobado en nombre de la Comunidad el Acuerdo en forma de memorándum de acuerdo entre la Comunidad Europea y Estados Unidos de América sobre bebidas espirituosas.
El texto del Acuerdo figura adjunto a la presente Decisión.
Artículo 2
Se autoriza a la Comisión a presentar a la Organización Mundial del Comercio las modificaciones al programa Comunidad Europea-Bebidas espirituosas CXL contenidas en el acuerdo anexo.
Artículo 3
Se autoriza al Presidente del Consejo para que designe a la persona autorizada para firmar el Acuerdo en forma de memorándum de acuerdo a fin de obligar a la Comunidad.
Artículo 4
La presente Decisión será publicada en el Diario Oficial de las Comunidades Europeas.

MEMORANDUM DE ACUERDO
ex 2208 Aguardientes, licores y demás bebidas espirituosas
Tal como se acordó en Singapur, hemos iniciado negociaciones pormenorizadas en relación con la eliminación de los derechos relativos a determinadas bebidas espirituosas.
En espera de la conclusión de nuestros respectivos procedimientos internos, y con la excepción del ron (2208 40), al que se aplican las disposiciones especiales establecidas en el Anexo, la Comunidad Europea y Estados Unidos eliminarán sus derechos, cuya entrada en vigor está prevista para el 1 de julio de 1997, relativos a las partidas SA 96 enumeradas a continuación en 4 fases iguales que darán comienzo el 1 de julio de 1997, seguidas por nuevas reducciones el 1 de enero de 1998, el 1 de enero de 1999 y el 1 de enero de 2000:

3. El ron y la tafia de un precio inferior al límite indicado anteriormente,
así como el ron y la tafia no sometidos a contingentes arancelarios, estarán sujetos a los derechos que figuran en el apartado 1.
4. La Comunidad Europea notificará rápidamente a Estados Unidos cualquier modificación del trato preferencial concedido a sus importaciones de ron que se haya introducido entre el 1 de enero de 2000 y el 1 de enero de 2003. Previa solicitud, la Comunidad Europea iniciará rápidamente consultas con Estados Unidos respecto a cualquier asunto relativo a las exportaciones estadounidenses de ron a la Comunidad conforme al apartado 2, a fin de alcanzar una solución común en esta materia.
