EL CONSEJO DE LAS COMUNIDADES EUROPEAS,
Visto el Tratado constitutivo de la Comunidad Económica Europea y, en particular, su artículo 113,
Vista la propuesta de la Comisión,
Considerando que, en espera de que terminen los procedimientos necesarios para su conclusión, el Acuerdo entre la Comunidad Económica Europea y la
República Popular de China sobre el comercio de productos textiles, rubricado el 9 de diciembre de 1988, se aplica provisionalmente desde el 1 de enero de 1989, de conformidad, en lo que se refiere a la Comunidad, con la Decisión 88/656/CEE (1);
Considerando que dicho Acuerdo prevé la posibilidad de volver a examinar, a la luz de la reciente evolución de los intercambios, los ajustes cuantitativos a aportar a las cuotas relativas a determinadas categorías, para tener en cuenta la introducción del sistema armonizado;
Considerando que, tras las consultas que han tenido lugar entre la Comunidad y la República Popular de China, un Acta aprobada que modifica las cuotas de las categorías 4, 5, 6, 7, 8, 10, 16, 21, 27, 67 y 73 previstas en el Acuerdo ha sido rubricada el 15 de diciembre de 1989;
Considerando que, en espera de que terminen los procedimientos necesarios para la conclusión del Acuerdo y del Acta aprobada, es conveniente aplicar provisionalmente el Acta aprobada, a partir del 1 de enero de 1990 a reserva de una aplicación recíproca por parte de la República Popular de China,
DECIDE:
Artículo 1
En espera de que terminen los procedimientos necesarios para su conclusión, a partir del 1 de enero de 1990 se aplicará provisionalmente en la Comunidad el Acta aprobada por la que se modifica el Acuerdo entre la Comunidad Económica Europea y la República Popular de China sobre el comercio de productos textiles, a reserva de una aplicación provisional recíproca por parte de la República Popular de China.
El texto del Acta aprobada se adjunta a la presente Decisión.
Artículo 2
Se invita a la Comisión a recabar el acuerdo del Gobierno de la República Popular de China sobre la aplicación provisional del Acta aprobada contemplada en el artículo 1 y a comunicarlo al Consejo.

Informacion relativa a la modificacion del Acuerdo entre la Comunidad y la Republica Popular de China sobre el comercio de productos textiles
De conformidad con el articulo 2 de la Decision del Consejo, de 2 de abril de 1990, sobre la aplicacion provisional del Acta aprobada por la que se modifica el Acuerdo con la Republica Popular de China sobre el comercio de productos textiles, la Comision comunico al Consejo el acuerdo que, mientras tanto, el pais asociado dio a este respecto .
AGREED MINUTE
1. A delegation of the People's Republic of China and a delegation of the European Economic Community met in Brussels from 25 September to 13 October 1989 and from 11 to 13 December 1989 in accordance with the provisions of Article 16 of the Agreement between the European Economic Community and the People's Republic of China on trade in textile products, initialled on 9 December 1988 and put into provisional application as from 1 January 1989, in order to examine the Chinese request for an adjustment of the quantitative limits on certain products affected by the implementation of the harmonized system.
2. As a result of the above consultations, the two Parties agreed to amend the quantitative limits set out in Annex III of the Agreement with regard to categories 4, 5, 6, 7, 8, 16, 21, 27, 73 and categories 10 and 67. The new quantitative limits for 1990 and the resulting limits for the years 1991 and 1992 are set out in Annex A to the present Agreed Minute.
3. The new allocation of the above quantitative limits among the regions of the Community for the year 1990 is indicated in Annex B to the present Agreed Minute.
4. The two Parties agreed that the special provisions of classification of
products affected by the introduction of the harmonized system of nomenclature (provisions 'box 9') agreed upon through exchanges of Notes Verbales (Note Verbale of the Chinese Mission, SF No 33/88, dated 16 March 1988; Note Verbale of the Community, No 4420, dated 14 April 1988; Note Verbale of the Chinese Mission, SF No 51/88, of 16 June 1988; Note Verbale of the Community, No 10339, of 26 July 1988; Note Verbale of the Chinese Mission, SF No 62/88, of 30 August 1988; Note Verbale of the Community, No 003204, of 15 February 1989), will no more be applied to goods shipped from China after 31 December 1989.
5. The two Parties further agreed that, without prejudice to the Agreed Minute No 7 of the Agreement on trade in textile products, the adjustments of the quantitative limits referred to in paragraph 2 above settle the questions of compensation due to the introduction of the harmonized system.

Información relativa a la modificación del Acuerdo entre la Comunidad y la República Popular de China sobre el comercio de productos textiles
De conformidad con el artículo 2 de la Decisión del Consejo, de 2 de abril de 1990, sobre la aplicación provisional del Acta aprobada por la que se modifica el Acuerdo con la República Popular de China sobre el comercio de productos textiles, la Comisión comunicó al Consejo el acuerdo que, mientras tanto, el país asociado dio a este respecto.
